Texas man gets 40 years in stand-your-ground case

A man who claimed Texas' version of a stand-your-ground law allowed him to fatally shoot a neighbor after an argument about a noisy party was sentenced Wednesday to 40 years for murder.

Raul Rodriguez, 46, had faced up to life in prison for the 2010 killing of Kelly Danaher.

Rodriguez, a retired Houston-area firefighter, was angry about the noise coming from a birthday party at his neighbor's home. He went over and got into an argument with 36-year-old elementary school teacher Danaher and two other men at the party.

In a 22-minute video he recorded on the night of the shooting, Rodriguez can be heard telling a police dispatcher "my life is in danger now" and "these people are going to go try and kill me." He then said, "I'm standing my ground here," and fatally shot Danaher and wounded the other two men.

Rodriguez's reference to standing his ground is similar to the claim made by George Zimmerman, a neighborhood watch volunteer who is citing Florida's stand-your-ground law in his defense in the fatal February shooting of an unarmed teenager, Trayvon Martin. Rodriguez's case, however, was decided under a different kind of self-defense doctrine.

Prosecutors called Rodriguez the aggressor who took a gun to complain about loud music and could have safely left his neighbor's driveway in Huffman, an unincorporated area about 30 miles northeast of Houston, any time before the shooting. Defense attorneys argued Rodriguez was defending himself when one of the men lunged at him and he had less than a second to respond.

At trial, prosecutors tried to show Rodriguez had a history of not getting along with Danaher and other neighbors.

One neighbor testified that Rodriguez, who had a concealed handgun license, bragged about his guns and told her a person could avoid prosecution in a shooting by telling authorities you were in fear of your life and were standing your ground and defending yourself. During the trial's punishment phase, neighbors, former co-workers and Rodriguez's ex-wife testified that Rodriguez was abusive, a bad neighbor and that he once shot a dog.

Rodriguez's attorneys did not present any witnesses before the jury convicted him on June 13. But during the punishment phase, they called more than a dozen witnesses, including his wife and sons. They and other family members testified that he was not abusive, always stressed the importance of gun safety and that he was not cavalier with his weapons. One son said Rodriguez shot the dog because it was attacking his family.

Texas' version of a stand-your-ground law is known as the Castle Doctrine. It was revised in 2007 to expand the right to use deadly force. The new version allows people to defend themselves in their homes, workplaces or vehicles. It also says a person using force cannot provoke the attacker or be involved in criminal activity at the time.

(AP) ? Greece's new prime minister is expected to be released from hospital later in the day, after undergoing eye surgery over the weekend that will prevent him from traveling to a critical European Union summit in Brussels this week.

Prime Minister Antonis Samaras was recovering from an operation to repair a detached retina, and was expected to leave hospital Monday afternoon. He has appointed Foreign Minister Dimitris Avramopoulos to lead the Greek delegation at the June 28-29 summit. Avramopoulos met Monday morning with outgoing Finance Minister Giorgos Zanias, Development Minister Costis Hatzidakis and others who will accompany him to Brussels.

Meanwhile, the country's designated finance minister remains hospitalized after collapsing on Friday.

Powell's London bid falls just short

Originally published June 23, 2012 at 8:17 PM | Page modified June 23, 2012 at 10:17 PM

In less than 13 seconds, Ginnie Powell-Crawford saw her future turned upside down.

Crawford, the former Rainier Beach High and USC competitor, was in position to make her first Olympic Games here Saturday evening, getting off well in the 100-meter hurdles. But she gave ground over the last half of the race, and finished a dispiriting fourth in the trials.

Fourth, of course, is where the disappointment begins.

"I don't know," Crawford said, turning philosophical to a handful of reporters. "I never thought it would be so disappointing to make me want to find something else to do."

But Crawford, at first blush, admitted she might be facing that crossroads. She turns 29 in September, and has now known the chagrin of making two Olympic trials finals and not landing on a team. She was sixth in 2008.

"The ending on my race has always been my weakness," she said. "It definitely hurt me today. It's something I haven't been able to figure out my whole hurdle career. No one has seemed to be able to fix that. I've been with two coaches, and somehow I just deteriorate and hit a wall."

Crawford said as her race developed from lane seven, she could sense Dawn Harper, in lane six, surging ahead. Harper won the race in 12.73, with Kellie Wells second in 12.77 and Lolo Jones, who had a late-race fall to thwart a gold-medal run in Beijing, third in 12.86. Crawford ran 12.90.

"I was hoping to look up (at the scoreboard) and see my name," Crawford said, "but I didn't."

She talked about the massive pressure in such an endeavor.

"Your livelihood is on the line every time you step out there," she said. "All that matters is 12 seconds, and it's all you. In a basketball game, LeBron James and the Miami Heat, you're out there with a whole team of people and you get seven games.

"Here, you get three rounds, two days, 12 seconds. It's super-cutthroat. I'm still under contract, it's financially OK, but I may find something else I want to do."

The women's 100 final provided a much less-concrete result.

After a long review, race officials determined Allyson Felix and Jeneba Tarmoh finished in a dead-heat for third place, each at 11.068 seconds. Only three spots are available at the Olympics and USA Track and Field officials were huddling, trying to solve a problem for which there is no written solution. Carmelita Jeter won the race in 10.92.

USA Track and Field officials were meeting late into the night to sort out how to break this sort of tie and who will join Jeter and second-place finisher Tianna Madison.

Spokeswoman Jill Geer said she didn't know when a decision would be reached.

Elsewhere, Tyson Gay made it through his first 100 heat cleanly, while LaShawn Merritt, Jeremy Wariner and Sanya Richards-Ross all advanced in the 400.

Expansion of forests in the European Arctic could result in the release of carbon dioxide

ScienceDaily (June 17, 2012) ? Carbon stored in Arctic tundra could be released into the atmosphere by new trees growing in the warmer region, exacerbating climate change, scientists have revealed.

The Arctic is getting greener as plant growth increases in response to a warmer climate. This greater plant growth means more carbon is stored in the increasing biomass, so it was previously thought the greening would result in more carbon dioxide being taken up from the atmosphere, thus helping to reduce the rate of global warming.

However, research published in Nature Climate Change, shows that, by stimulating decomposition rates in soils, the expansion of forest into tundra in arctic Sweden could result in the release of carbon dioxide to the atmosphere.

Dr Iain Hartley now based in Geography at the University of Exeter, and lead author of the paper, said: "Determining directly how carbon storage is changing in high-latitude ecosystems is very difficult because the majority of the carbon present is stored below ground in the soils. Our work indicates that greater plant biomass may not always translate into greater carbon storage at the ecosystem level.

"We need to better understand how the anticipated changes in the distribution of different plant communities in the Arctic affects the decomposition of the large carbon stocks in tundra soils if we are to be able to predict how arctic greening will affect carbon dioxide uptake or release in the future."

By measuring carbon stocks in vegetation and soils between tundra and neighbouring birch forest, it was shown that compared to tundra, the two-fold greater carbon storage in plant biomass in the forest was more than outweighed by the smaller carbon stocks in forest soils.

Furthermore, using a novel methodology based on measuring the radiocarbon content of the carbon dioxide being released, the researchers found that the birch trees appeared to be stimulating the decomposition of soil organic matter. Thus, the research was able to identify a mechanism by which the birch trees can contribute directly to reducing carbon storage in soils.

"Dr Gareth Phoenix, of the University of Sheffield's Department Animal and Plant Sciences, who collaborated on the research, added:

"It shows that the encroachment of trees onto Arctic tundra caused by the warming may cause large release of carbon to the atmosphere, which would be bad for global warming.

"This is because tundra soil contains a lot of stored organic matter, due to slow decomposition, but the trees stimulate the decomposition of this material. So, where before we thought trees moving onto tundra would increase carbon storage it seems the opposite may be true. So, more bad news for climate change."

The results of the study are in sharp contrast to the predictions of models which expect total carbon storage to increase with the greater plant growth. Rather, this research suggests that colonisation by productive, high-biomass, plant communities in the Arctic may not always result in greater capture of carbon dioxide, but instead net losses of carbon are possible if the decomposition of the large carbon stocks in Arctic soils are stimulated. This is important as Arctic soils currently store more carbon than is present in the atmosphere as carbon dioxide and thus have considerable potential to affect rates of climate change. It is yet to be seen whether this observed pattern is confined to certain soil conditions and colonising tree species, or whether the carbon stocks in the soils of other arctic or alpine ecosystems may be vulnerable to colonisation by new plant communities as the climate continues to warm.

A Deeper Look Inside Apple?s Secrecy And Its Sustainability

wwdc-top-secret-apple-steve-jobsWWDC this past week confirmed that Apple is?as strong as ever. The company?s steady stream of new products and announcements are a good indication that it?s business as usual. But when will Apple face its first real post-Steve Jobs test? It?s hard to say but not anytime soon. Last week?at Startup Grind?in Palo Alto?I sat down with Adam Lashinsky, the author of?Inside Apple: How America's Most Admired and Secretive Company Really Works. The book is the most compelling inside look I've seen of the culture and attitude that Steve Jobs instilled after his return in 1997 and what it will take to maintain that lead without him. Carlos Slim acquires stake in Argentine power co.

Mexican telecommunications billionaire Carlos Slim has acquired an 8.4 percent stake in Argentina's newly state-controlled oil and gas producer, YPF S.A.

Slim and members of his family bought 32.9 million shares of YPF Class D shares on Tuesday and Wednesday, according to a filing with the Securities and Exchange Commission on Thursday.

Shares of YPF that trade on the New York Stock Exchange rose $1.21, or 11.6 percent, to $11.66 in morning trading on Friday. The stock is near the bottom of its 52-week range of $10.13 to $46.60.

The stock has tumbled since Argentina's center-left government expropriated YPF by seizing a majority stake from Spain's Repsol two months ago. The company operates under a mixed public-private arrangement under the supervision of the SEC and Argentina's regulator.

A lot of us love to swim so we want to look good in those bathing suits. If its not swimming its baseball, track, or some outdoor activity that we are trying to stay in shape for. I have found a great service that can help you stay on track!? It?s called THE KLUTCH CLUB

Aung San Suu Kyi's 'test run' outside of Myanmar (+video)

On her first international trip since 1988, Aung San Suu Kyi is in Thailand to attend a World Economic Forum summit on Friday. Next month she will travel to Europe, collecting while there the Nobel Peace Prize awarded her in 1991.

Myanmar opposition leader Aung San Suu Kyi waves while leaving a community center in Mahachai, Samut Sakhon Province, Thailand on Wednesday, May 30. Kicking off her first trip abroad since 1988, to attend a World Economic Forum summit on Friday.

Not for nearly 25 years has Aung San Suu Kyi dared step outside her homeland. Not even to see her husband as he lay dying in Britain. If she ever left, she feared, Myanmar?s military government would never let her return home.

Determined never to give up, the woman who has become an icon not only for her own people but for democracy activists worldwide refused to give the generals an opportunity to sideline her. She put up with 15 years of house arrest rather than risk becoming an exiled irrelevance.

Now she is on her first international trip since 1988, visiting neighboring Thailand to attend a World Economic Forum summit on Friday, in a sign of her confidence in recent reforms in Myanmar (also known as Burma).

Today, though, her first full day abroad, she must have felt right at home.

Ms. Aung San Suu Kyi spent the morning in the town of Mahachai, home to Thailand?s largest community of Burmese migrant workers. Thousands mobbed her before she addressed the crowd from the balcony of a community center.?

Around 2.5 million impoverished Burmese have fled their country in search of jobs in Thailand ? an illustration of how badly Myanmar?s economy suffered under nearly half a century of military rule.

Sorting out that mess is one of the prime tasks facing Myanmar?s nominally civilian government. The political reforms the government has pushed through over the past 12 months ? including partial parliamentary elections in April that Aung San Suu Kyi?s party won by a landslide ? are generally seen as a first step toward economic recovery since they have prompted Western nations to suspend damaging economic sanctions.

On Friday, at the World Economic Forum, Aung San Suu Kyi will be addressing the sorts of Asian movers and shakers whom Myanmar is counting on to invest in the country?s economic revival. Businessmen from around the world have recently been pouring into Yangon, the country?s commercial capital, seeking opportunities as Myanmar opens up to the rest of the world.

Aung San Suu Kyi?s trip to Thailand is a sort of test run, though nobody seriously expects the Myanmar government to turn her back when she flies home to Yangon this weekend.

?Next month she sets off on a more ambitious journey, and one freighted with sentiment as much as with politics, to Europe.

Besides visiting Switzerland and Ireland, Aung San Suu Kyi will go to Britain, where she was living before she returned to Myanmar in 1988 to care for her ailing mother, and where her British husband died in her absence. She will also go to Oslo, to formally accept the Nobel Peace Prize that she could not collect in person in 1991, for fear of getting stuck outside her homeland.?
